The expungement process is available to residents and/or non-residents of the State of New Jersey. Expungement is a court process that can allow you to remove certain items from your criminal record, depending on the situation. The purpose of New Jersey’s expungement law is to give a person who has either one or very few convictions a “fresh start.” The law also provides for the removal of records of arrests where the arrest did not end in a conviction.
WHO IS ELIGIBLE FOR EXPUNGEMENT? ↑ The answer to this basic question depends on the type and number of criminal records you have. The type of records means whether a conviction was for an "indictable offense", for a "disorderly persons offense" , or for a violation of a municipal ordinance. WHY EXPUNGE YOUR CRIMINAL RECORD? ↑ A common reason for expungement is to clear one's criminal record for job applications, to run for public office or for school loans. Juvenile records are often expunged, so that bad judgment as a teenager does not haunt the person forever. An Expungement Order means that, with some exceptions, the criminal proceedings “NEVER HAPPENED.” WHAT CRIMES CANNOT BE EXPUNGED? ↑ Some examples of certain crimes that cannot be expunged are: Criminal Homicide, except death by auto, Kidnapping, Luring or Enticing, Aggravated Sexual Assault, Aggravated Criminal Sexual Contact, Criminal Sexual Contact, Criminal Restraint, False Imprisonment, Robbery, Arson and Related Offenses, Endangering the welfare of a child by engaging in sexual conduct which would impair or debauch the morals of the child, Endangering the welfare of a child, Perjury, False Swearing, conspiracies or attempts to commit such crimes and Motor vehicle convictions, such as diving under the influence of alcohol or drugs cannot be expunged. Also, convictions for the sale, distribution, or possession of any controlled dangerous substance with intent to sell (other than for less than 25grams of marijuana or 5 grams or less of hashish) cannot be expunged. However, young drug offenders get special consideration for certain convictions. DO I HAVE TO APPEAR IN COURT? ↑ In most cases - NO, your appearance in court is rarely necessary so you won't have to take any time from your busy schedule to attend court. An attorney will appear in court on your behalf. Only in extremely rare cases will a judge request for you to appear in court. WHAT IF I DON'T HAVE ANY PAPER WORK? ↑That is NO problem. I can obtain all the required paper work through the proper police departments and courts at NO extra charge. IS AN OFFICE VISIT REQUIRED ? ↑No, the entire expungement process can be performed over the telephone, e-mail and mail. There is no need for you to take any time off from work. DOES A "DISMISSED" CHARGE STILL APPEAR ON MY RECORD? ↑ YES, even a "Dismissed" charge leaves you with an arrest record.
